Wills, Estate Planning & Administration

We provide Estate Planning for all Estates, including but not limited to the preparation of Wills, Living Trusts, Special Needs Trusts, Health Care Proxies and Powers of Attorney.

We also provide Estate Administration.  An Estate requires Administration when a person dies owning Assets such as Real Estate, Stocks/Bonds, Cash, Cars, etc.  A representative of the Estate (usually a family member named in the Will) must file a Petition with the Surrogate's Court to become the legal representative of the Estate (Executor).  The legal representative is responsible to pay all of the debts and liabilites of the estate and distribute the assets of the estate in accordance with the terms of the Will.  If a person dies without a Will (Intestate), then the provisions of Article 4 of the Estates, Powers and Trust Law of New York govern how the Estate is to be distributed.

By creating a Will, you can appoint your Estate representaitve in advance (to avoid unecessary disputes between family members during the Administration process) and most importantly, you can direct where and to who your Estate assets will go when you die.
